Chapter 1 General provisions

Article 1 (Purpose)

These terms set out the conditions and procedures for using every service (the "Service") provided by this site Spartan OS (the "Company").

Article 2 (Definitions)

The terms used in this document are defined as follows.
1. User : a person who receives the Service provided by the Company under these terms
2. Use agreement : the agreement concluded between the Company and a user in connection with use of the Service
3. Registration : completing the use agreement by entering the required information in the Company's application form and agreeing to these terms
4. Member : a person who has registered with this site by providing the personal data required for membership
5. User ID : a combination of letters and digits chosen by the user and approved by the Company, used to identify the member and to let the member use the Service (only one ID may be issued per resident registration number)
6. Password : a combination of letters, digits and symbols set by the user to protect the member's information
7. Termination of use : a declaration by the Company or the member ending the use agreement after the Service has been used

Article 3 (Effect and amendment of these terms)

A member who does not agree to amended terms may ask to close their account. If the member continues to use the Service without objecting for 7 days after the amended terms take effect, they are deemed to have agreed to the amendment.
① These terms take effect when posted on the Service screen, on the notice board, or announced by other means.
② The Company may amend these terms where it deems it necessary. Amended terms are announced on the Service screen, and a member who continues to use the Service without objecting for 7 days after the announcement is deemed to have agreed to the amendment.
③ A user who does not agree to the amended terms may stop using the Service and cancel their registration. Continued use is deemed agreement, and the amended terms take effect in the manner described in the preceding paragraph.

Article 4 (Supplementary rules)

Matters not specified in these terms are governed by the Framework Act on Telecommunications, the Telecommunications Business Act and other applicable law.

Chapter 2 Service use agreement

Article 5 (Conclusion of the use agreement)

The use agreement is concluded by the Company's acceptance of the user's application and the user's agreement to these terms.

Article 6 (Application for use)

An application is made by entering personal details in the registration form required by the Company on the member information screen of the Service.

Article 7 (Acceptance of an application)

① Where a member applies with every item of the form completed accurately, the Company accepts the application unless there is a particular reason not to.
② The Company may decline to accept an application in the following cases.
1. The application was not made under the applicant's real name
2. The application was made using another person's name
3. The application contains false information
4. The application was made for the purpose of harming public order or good morals
5. The application otherwise fails to meet the requirements set by the Company

Article 8 (Changes to agreement details)

A member must update the details given when applying if they change. The member is responsible for any problem arising from a failure to update them.

Chapter 3 Obligations of the parties

Article 9 (Obligations of the Company)

The Company does not disclose or distribute to third parties, without the member's consent, personal details of the member that it learns in connection with providing the Service. This does not apply where a state body makes a request under provisions of law such as the Framework Act on Telecommunications, where there is a criminal investigation purpose, or where a request is made under a procedure laid down in other applicable law.

Article 10 (Obligations of the member)

① A member must not do any of the following when using the Service.
1. Using another member's ID improperly
2. Copying or publishing information obtained from the Service, or providing it to a third party
3. Infringing the copyright of the Company or a third party, or other rights
4. Distributing content that violates public order or good morals
5. Conduct that is objectively judged to be connected with a crime
6. Any other conduct that violates applicable law
② A member may not carry on commercial activity through the Service, and the Company is not liable for any outcome of such use.
③ A member may not transfer or give their right to use the Service or their position under the use agreement to another person, nor offer it as security.

Chapter 4 Use of the service

Article 11 (Obligations of the member)

① A member is responsible for maintaining their own mail, boards and uploaded material as needed.
② A member may not delete or alter material provided by the Company at will.
③ A member must not post on the Company's site content that violates public order or good morals, or that infringes the copyright or other rights of a third party. The member bears full responsibility for any consequence of posting such content.
Article 12 (Management and deletion of posts)

For efficient operation of the Service, the Company may limit members' storage space, message size and retention period, and may delete content without prior notice in the following cases.
1. Content that defames another member or a third party, or damages their reputation through slander
2. Content that violates public order or good morals
3. Content recognised as connected with criminal conduct
4. Content that infringes the copyright of the Company or a third party, or other rights
5. Where a member posts obscene material on the Company's site or boards, or links to an obscene site
6. Content otherwise judged to violate applicable law

Article 13 (Copyright in posts)

Copyright in a post belongs to its author. A member may not use material published on the Service commercially, including by processing or selling information obtained through the Service.

Article 14 (Service hours)

The Service is in principle available 24 hours a day, every day of the year, unless there is a particular operational or technical obstacle. This does not apply during scheduled maintenance and similar events.

Article 15 (Responsibility for use of the Service)

A member must not use the Service for hacking, linking to obscene sites, illegally distributing commercial software or similar conduct. The Company is not liable for the results or losses of commercial activity arising from such a violation, or for legal measures taken by the authorities.

Article 16 (Suspension of the Service)

The Company may suspend the Service in the following cases.
1. Where it is unavoidable owing to work such as repair of service equipment
2. Where a network telecommunications operator under the Telecommunications Business Act has suspended its telecommunications service
3. Where system maintenance is required
4. Where there is another event of force majeure

Chapter 5 Termination and restriction of use

Article 17 (Termination and restriction of use)

① A member who wishes to terminate the use agreement must apply for termination online in person, and the Company acts on it after confirming the member's identity.
② Where a member has done any of the following, the Company must notify the member 30 days before terminating and give them an opportunity to state their case.
1. Misappropriating another person's user ID and password
2. Deliberately obstructing operation of the Service
3. Applying for membership with false information
4. Registering twice as the same person under different IDs
5. Distributing content harmful to public order or good morals
6. Damaging another person's reputation or causing them disadvantage
7. Sending large volumes of information or marketing messages in order to disrupt stable operation of the Service
8. Distributing computer viruses or similar programs that cause information and communications equipment to malfunction or destroy information
9. Infringing the intellectual property rights of the Company, another member or a third party
10. Improperly using another person's personal data, user ID or password
11. Posting obscene material on their own homepage or boards, or linking to an obscene site
12. Any other conduct judged to violate applicable law

Chapter 6 Miscellaneous

Article 18 (No transfer)

A member may not transfer or give their right to use the Service or their position under the use agreement to another person, nor offer it as security.

Article 19 (Damages)

The Company is not liable for any damage suffered by a member in connection with services provided free of charge, except where the damage results from the Company's intent or gross negligence.

Article 20 (Exemptions)

① The Company is exempt from responsibility for providing the Service where it cannot do so owing to a natural disaster, war or comparable force majeure.
② The Company is exempt from liability for damage arising from unavoidable causes such as repair, replacement, scheduled inspection or construction work on service equipment.
③ The Company is not liable for disruption to use of the Service caused by the member.
④ The Company is not liable for benefits a member expects from using the Service, or for damage arising from material obtained through the Service.
⑤ The Company is not liable for the reliability or accuracy of information, material or statements posted on the Service by a member.
Article 21 (Jurisdiction)

Where a lawsuit is brought over a dispute arising from use of the Service, the court with jurisdiction over the Company's place of business has exclusive jurisdiction.

Addendum

(Effective date) These terms take effect on 20 August 2026.
